| 1. Acceptance of Terms
By accessing or using the Makeitbuy website (makeitbuy.com) or making a purchase, you agree to be bound by these Terms of Service, our Privacy Policy, and our Cookie Policy. If you do not agree, please do not use our website.
We may update these Terms at any time. Material changes will be communicated via email or a banner on our website. Your continued use of the site after changes constitutes acceptance of the updated Terms.
| 2. About Makeitbuy
Makeitbuy is operated by Makeitfy, a business registered in Italy. We operate as both a direct retailer of our own original products and as a marketplace platform facilitating sales between independent sellers and customers.
For all transactions on our platform, Makeitbuy acts as the merchant of record unless otherwise specified at the point of purchase.
| 3. Eligibility
By using this website, you confirm that:
- You are at least 18 years of age, or have the consent of a parent or legal guardian
- You are capable of entering into a binding legal contract
- You will provide accurate, complete, and current information when placing orders or creating an account
- You are not barred from using our services under any applicable law
| 4. Orders & Formation of Contract
Placing an order on Makeitbuy constitutes an offer to purchase. A binding contract is formed only when we send you an Order Confirmation email.
We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to:
- Errors in product description or pricing
- Suspected fraudulent activity
- Product out of stock after order placement
- Failure of payment authorisation
In such cases, we will notify you promptly and issue a full refund of any payment taken.
| 5. Pricing & Payment
All prices displayed on our website are in EUR and include VAT where applicable. Shipping costs are shown separately at checkout.
We accept: Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, and Klarna (where available).
⚠️ Pricing errors: If a product is listed at an obviously incorrect price due to a technical error, we reserve the right to cancel the order and refund you in full, even after an order confirmation has been sent.
| 6. Products & Descriptions
We make every effort to ensure product descriptions, images, and specifications are accurate. However, we cannot guarantee that your device’s display will render colours exactly as they appear in person.
For our 3D-printed original products, slight variations in finish between units are inherent to the manufacturing process and are not considered defects.
| 7. User Accounts
When creating an account, you are responsible for maintaining the security of your login credentials and for all activity under your account. You must notify us immediately at hello@makeitbuy.com if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse our return or refund policies.
| 8. Prohibited Use
You may not use Makeitbuy to:
- Engage in fraudulent, deceptive, or harmful conduct
- Place orders with no genuine intent to purchase (order farming)
- Abuse return or refund processes
- Scrape, crawl, or systematically extract data from our website without prior written consent
- Introduce malware, viruses, or other harmful code
- Violate any applicable local, national, or international laws
- Infringe on the intellectual property rights of Makeitbuy or any third party
- Harass, threaten, or abuse our team or other users
| 9. Intellectual Property
All content on this website — including text, graphics, logos, product designs, photography, and software — is the property of Makeitbuy / Makeitfy or its content licensors and is protected by Italian and EU intellectual property law.
Our original product designs (3D-printed items and decor) are proprietary designs. Reproduction, copying, or commercial use without prior written permission is strictly prohibited.
| 10. Marketplace Sellers
Makeitbuy allows approved third-party sellers to list products on our platform. While we review all sellers and products before approval, we do not manufacture or own third-party products.
Third-party sellers are responsible for the accuracy of their product listings, fulfilment of orders, and compliance with all applicable laws. Makeitbuy will always mediate disputes and intervene where sellers fail to meet their obligations.
| 11. Limitation of Liability
To the maximum extent permitted by law, Makeitbuy’s total liability shall not exceed the total amount paid by you for the relevant order. We shall not be liable for:
- Indirect, incidental, or consequential losses
- Loss of profits or business opportunities
- Losses arising from circumstances beyond our reasonable control (force majeure)
- Losses caused by third-party service providers (carriers, payment processors)
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Italian or EU law. Your statutory consumer rights are not affected.
| 12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Italy and, where applicable, EU regulations. Any disputes shall be subject to the exclusive jurisdiction of the Italian courts.
We encourage you to contact us first to resolve any dispute amicably. If we cannot reach an agreement, you may use the EU Online Dispute Resolution.
